2. Description of Service
MoveCalendar is a fitness consistency tracking application that helps users monitor their fitness activities through customizable rules and visual calendar tracking. The App integrates with Apple HealthKit to automatically track fitness metrics and provides widgets for home screen display.
3. Eligibility
You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement.
4. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use.
5. User Responsibilities
5.1 Health Data
You are responsible for the accuracy of any health and fitness data you provide or that is collected through HealthKit integration.
The App is designed to help you track fitness activities and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
Always consult with a qualified healthcare provider before starting any new fitness program.
5.2 Account Conduct
You agree to:
Use the App only for lawful purposes
Not attempt to reverse engineer, decompile, or disassemble the App
Not use the App in any way that could damage, disable, or impair the App
Not attempt to gain unauthorized access to any portion of the App
6. HealthKit Integration
6.1 Data Access
The App requests read-only access to specific HealthKit data including:
Step count
Active energy burned
Distance (running, cycling, swimming)
Workout sessions
Exercise minutes
6.2 Data Usage
HealthKit data is used solely to evaluate your custom fitness rules and display progress
All HealthKit data remains stored locally on your device
We do not transmit, store, or share your HealthKit data with any third parties
You can revoke HealthKit permissions at any time through iOS Settings
7. MoveCalendar Pro Subscription
7.1 Subscription Features
MoveCalendar Pro is an optional subscription that provides:
Home screen widgets (calendar and task widgets)
Unlimited historical data access
Future premium features as they become available
7.2 Billing and Payment
Subscriptions are billed through your Apple ID account
Payment will be charged to your Apple ID account at confirmation of purchase
We use RevenueCat to manage subscription entitlements and verify purchase status
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your App Store account settings
RevenueCat processes subscription validation data in accordance with their Terms of Service and Privacy Policy
7.3 Free Trial
If offered, free trials allow you to try MoveCalendar Pro features before being charged
You may cancel during the trial period to avoid charges
If you do not cancel before the trial ends, you will be charged the subscription fee
7.4 Cancellation and Refunds
You may cancel your subscription at any time through your Apple ID account settings
Cancellation takes effect at the end of the current billing period
No refunds will be provided for partial subscription periods
Refund requests are subject to Apple's refund policies
8. Intellectual Property
8.1 Ownership
The App, including all content, features, functionality, source code, and design, is owned by the developer and is protected by international copyright, trademark, and other intellectual property laws.
8.2 Trademarks
MoveCalendar and related logos are trademarks or registered trademarks. You may not use these marks without prior written permission.
9. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we handle your information. By using the App, you agree to our Privacy Policy.
The App uses RevenueCat for subscription management. RevenueCat's collection and use of data is governed by their Privacy Policy, available at https://www.revenuecat.com/privacy
10. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.2 No Medical Advice
The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information provided by the App should not be considered medical advice. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
10.3 Accuracy
We do not warrant that:
The App will be uninterrupted, secure, or error-free
The results obtained from the use of the App will be accurate or reliable
Any errors in the App will be corrected
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
Your use or inability to use the App
Any unauthorized access to or use of the App
Any interruption or cessation of the App
Any bugs, viruses, or other harmful code transmitted through the App
Any errors or omissions in any content
12. Indemnification
You agree to indemnify, defend, and hold harmless the developer from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
Your access to or use of the App
Your violation of these Terms
Your violation of any third-party rights
13. Changes to the App
We reserve the right to:
Modify or discontinue, temporarily or permanently, the App or any features within the App
Change subscription pricing with reasonable notice
Update these Terms at any time
We will provide notice of material changes through the App or other reasonable means. Your continued use of the App after such changes constitutes acceptance of the new Terms.
14. Termination
14.1 By You
You may stop using the App at any time by deleting it from your device.
14.2 By Us
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
14.3 Effect of Termination
Upon termination:
Your right to use the App will immediately cease
All provisions of these Terms that by their nature should survive termination shall survive
15. Geographic Restrictions
The App is controlled and operated from within the United States. We make no representations that the App is appropriate or available for use in other locations. If you use the App from other locations, you are responsible for compliance with local laws.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer is located, without regard to its conflict of law provisions.
17. Dispute Resolution
17.1 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally by contacting you.
17.2 Arbitration
If a dispute is not resolved within 30 days of submission, any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
17.3 Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated or resolved on a class action basis.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.
20. No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

22.1 Apple App Store Terms
You acknowledge and agree that:
These Terms are between you and the developer only, not with Apple Inc.
Apple has no obligation to furnish any maintenance and support services with respect to the App
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you
Apple has no other warranty obligation with respect to the App
Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App
Apple is a third-party beneficiary of these Terms and has the right to enforce these Terms against you
22.2 RevenueCat
The App uses RevenueCat for subscription management. Your use of subscription features is subject to RevenueCat's Terms of Service. We are not responsible for any issues arising from RevenueCat's services, though we will work to resolve any subscription-related problems. By using MoveCalendar, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
